Unit being sold. Current owner wants Assn to repair failing tape on firewall in attic. Failing after 20 yrs due to moisture/condensation cycle. On reading our B/Laws, We are in CT - I don't think Association responsibility - and would appreciate your input or comments. Thank you...

Our Assn by-laws state the following:
(a) Upper Boundary;
IS 1. townhouse Units:
the horizontal or sloping plane or planes of the
unfinished lower surfaces of the roof bearing structure surfaces, beams, and rafters extended to an
intersection with the vertical perineter boundaries.
2. Ranch Units:
the horizontal or sloping plane or planes of the
unfinished lower surfaces of the roof bearing structure surfaces, beams, and rafters extended to an
interøection with the vertical perimeter boundaries.
(b) Lower Boundary:
1. Townhouse Units:
The horizontal plane or planes of the undecorated or
unfinished upper surfaces of the floors, including
pouted concrete floors, extended to an intersection
with the vertical perimeter boundaries.
2. Ranch Units:
The horizontal plane or planes of the undecorated or
unfinished upper surfaces of the floors, including
poured concrete floors, extended to an intersection
with the vertical perimeter boundaries
a) vertical Perineter Boundaries; the planes defined by
the inner surfaces of the studs and framing of the
perimeter walls: the unfinished inner surfaces of
poured concrete walls and thronholds along perimeter
walls and floors: the unfinishod inner surfaces of
closed windows arid closed perimeter doors: and the innermost unfinished surface of all interier bearing
studs and framing of bearing walls, columns, bearing
partitions, and partition walls between separate Units.

I wouldn't trust a home owner to make repairs to a firewall. The homeowner might just hire a cheap handyman who slaps some mud on it and calls it done. You need special fire rated tape installed and someone that knows how to install it and where.

Personally, I would consiter anything to do with firewall protection to be structural.

I just looked at your photo. That is paper tape, which is flammable. Its not even fire tape.

As I interpret the 'specs' the HO is responsible for any and all sheet-rock (dry-wall) which faces or is visible in the occupied space.

If this peeling tape is in the vertical dividing firewalls (separating adjoining units) up in the attic it is definately the HOA's responsibility.

If it is in the unit's occupied wall surfaces it is the HO's problem.

THIS IS A LIFE SAFETY ISSUE WHICH COULD VOID THE C of O FOR THE ENTIRE STRUCTURE

What the blazes is wrong with the BOD ?

GET IT FIXED - YESTERDAY IF POSSIBLE
