Has anyone had any experience in Georgia converting a Voluntary HOA to a Mandatory HOA? There has been increased support of this in the neighborhood. Thanks in advance for your help.

Personally, I have not but if you have increased support, I would certainly look into it more and make the change. Try looking on the Community Associations Network site at the right, under GA. Also, check www.wncwlaw.com...they are an HOA/Real Estate law firm in the Atlanta area that may have some good information on it.

I too live in Georgia. I haven’t had the experience of making the switch from voluntary to mandatory HOA either. What exactly is the difference? My sub-division is Mandatory HOA. You as a homeowner knew that there would be a yearly assessment due the first of every year. We knew that when we decided to build here.

What about assessment? Because it is voluntary does this mean you pay them if you want too? So some people do while others don’t? Is this how it works? If this is the case, I sympathize with you. I can’t imagine how difficult it would be.
Maybe you or someone else can explain to me the difference. I have an idea, but I’m thinking its wrong, because you said many in your community are all in favor of going to a mandatory HOA. What about all the homeowners that decided to build their home in a non-HOA community? That didn’t want to live in an HOA enforced community. For what ever there reason was.

I would think to make such a dramatic switch; you would need 100% approval from all the residents. This might not be the case at all. I’m not sure! It’s definitely something to look into.
