At the condo, we have a rule that NO GLASS items in the pool area. It is on a sign in the pool area but not so mentioned in the CC&Rs.

If an individual(s) bring in glass bottles or glass items and are told to remove them, how do we enforce it.. they just say go away and leave us alone.... If the city inspector came in, I suspect he/she would close down the pool. But as individuals attempting to keep glassware out of the pool area, do we call the police or just let it go?No, they will not say what condo unit they are from otherwise one might fine the owner

Your propblem is not glasscontainers in the pool area, and I bet you know it. I would wonder if you may be looking for a way to do other enforcements, by getting this done. But.......no matter.......every pool in the country probably has rules posted. Yours should site your Board of Directors as the enforcing authority and site fines for offenses.

Now, once you have done that, then the board should enforce the rules. I have heard some talk recently if the BOD neglects to enforce the rules and covenants, they could he at question about their fiduciary responsibilities. Reason being this is a willful act that puts the association as a whole at risk.

Anyway, the onus is on the Board. I also know if they locked up all the Board members that have no interest in stopping people from bringing glass containers to the pool area, they would not be any one left to run the Board. So, where does that leave you, if you board is not doing their job. Get new Board members that will enforce your rules, get the board to hire pool attendents, hire a off duty policeman. give him/her authority to enforce the rules. You could set up a owners rule enforcement sommittee.

Best guess would be to push hard and enforce the rules for unscheduled periods and levy fines on owners. Require a pool pass, and be fair and strict. Pool passes must be carried or no pool attendence, those passes must list unit name and phone # of owner. Give your enforcer a cell phone, have him call immediately and inform owner he will be fined unless he instructs his guest or whatever to remove the glass immediately. That will work maybe 80%.

It is a problem and a serious problem and deserves attention or take out the pool. You also may consider a surcharge for those using the pool to pay for the enforcement, it is a board call.
