My association says that we can only have a fish in a tank with certain dimensions. An amendment was made in 2000 saying: "NO PETS." Isn't there a California law that overwrites this?

A fish tank isn't really a pet but the size regulation of the tank probably has more to do with the weight of the tank. They are worries about the floor supports if someone installs a 150 gallon tank and its sitting in between floor supports. It could cause major structural damage. So yes, they can limit the size legally.

As for California law, i duno. Go to the states web page and do some searching.

How would they even know you had a fish? If its a weight issue,can you be stopped from having a water bed?

get yourself and others on the board who think like you do, and following procedures, make a new pet rule. Typically, new members are elected every year, so you might be able to affect a change by this time next year.

Yes, many waterbeds are also banned from many places for this same reason. The damage would be devastating. Some apartments only allow them if you provide proof of insurance to cover damage from them.
