I am trying to better understand how the lien process works here in the State of California in so far as placing and enforcing a lien for unpaid dues. On more than one occasion our management company has asked us (BOD) to authorize a lien, and, once we have done so, the liens were not filed. The owners, one of which is a bank, still have not paid and we need the money.

I am not an attorney, and therefore find any effort to read and really comprehend the civil code is a little beyond me.

Advice on how the process works would be appreciated.

Patricia, I would suggest you visit (http://www.davis-stirling.com/) scroll down the list on the left to (liens and foreclosures) they explain the process in easy to understand terms including the steps an Association must take.

Have you asked the MC why the authorized liens have not been filed?

Glenn, I will check out your suggestion. Yes I have asked them why; their answers are often not clear and I do not completely trust them.
