We have a an HOA in Florida with 181 SFH. We are currently preparing a letter to send to landlords reminding them that it is there responsibility to see that their tenants are aware of the rules & regulations of our HOA. As a board member, I suggested that the letter also ask that the landlord send the board a copy of the lease for any new tenants. Just wondering if this is legal, as some board members felt there might be a "right to privacy issue" here. As it is now, we have no way of knowing who is living in the rental house or even how many are supposed to be in the house.

Our bylaws state the owner must sent a copy of the lease.The owner is responsible for their tenant obeying all bylaws.

If you have a rental policy in your documents, the requirement to have a lease on file for all rental units is fine. Legal?, Not a problem as long as it is included with the rental policy. I don't know what you have for documents on this but ALL of my 3 rental unit associations do require a copy of the lease. I just "white out" the rent amount. That is my business and my tenants, not the BODs.

Yup, same here. Our documents require the owner to provide the Association with a copy of the lease. Here is an example as to why---one owner's lease stated that no pets over 50 pounds are allowed. The Association Rules state no pets over 15 pounds. OUR rules trump the owners rules if it's in violation with the association rules and documents.
