We have a lot with only a foundation. The lot owner passed last summer before he finished building and his relation, who owns it now, has attempted to sell the lot. I think it is way over priced. When do we say enough and ask for the lot to be cleaned up (large piles of dirt, pallet of bricks, etc)and the foundation removed.

I see not problem with the Board ordering and fining this property (no matter who owns it) if the conditions violated your covenants.

Once you get the lot in compliance, I would think the Board would want to contact the owner and attempt for an aggreement as to when the lot would be improved. A reasonable time frame should be given for this to happen. It seems clear if the lot as presented is in violation of the buiding requirements for the lots in the association, they Board can take any action to render that compliance. Are you going to find a time line for this? I doubt it.....common sense tells you these kind of things happen and resolutions are agreed on, so, work to resolve the problem and fine the owners if they don't clean up the lot.

Our municpality has an ordinance that outlines the time frame for completion of a home. Since the owner is deceased, it is probably in an estate, but that does not give the heirs an out for making sure the property is well maintained.

Bring in some help on this. To let this lot remain like this is not good for property values in your association.
