Pointe West condo assoc. in New Port Richey Florida has decided to collect all the fees for the rec. facilities raising the Association fees $62 per month. Without any legal documentation I have paid the rec. fees for the first quarter of this year and now the Assoc. has requested I pay them the increase to cover the rec. facilities. How can the unit owners be expected to pay the same fee to both Associations without legal action, which now I am told is pending. It is double dipping at this point and I am being told by The Rec. Facility Assoc. to pay, and the condo Assoc.

Do your gov docs state you must pay both an association fee and a rec center fee? Is the assn now collecting the rec center fee? More explanation of the situation would be appreciated.

Yes, both sent new coupon books for Jan. 2009. First one was received by the Rec. Facility Association, second was a notice after the 1st of Jan., new coupon book with a letter stating not to pay the Rec. fees, which was too late since payment was due on the 1st. I called the Rec. Assoc. and they said the Condo Assoc., had no legal right to collect their fees or increase the Assoc. dues to include the Rec. facilities. The Assoc. said I had to get my fees returned from the Rec. Assoc. which they refused to return.

It appears the Condo Assn and the Rec Facility Assn are not on the same page! I would go by what your docs state. Has the Condo Assn informed the members why they have changed this procedure and by what authority?

I asked the association for a legal document stating they now are collecting the rec. fees, they sent me a letter from their attorney that "advises" the association to now collect the fees and tell the unit owners not to pay the rec. fees. This is their attorney's advise, but not a legal document allowing this change. The rec. association says the condo association has no right to do this and will not refund my first quarterly payment they received. Now the association is sending me letters that I owe them more money for Jan. and Feb. increase in fees and can not get the rec. fee money I sent transferred to them. The rec. association is having a meeting and so is the condo association due to the rec. association taking this to court which is supposed to be pending. The fees for the rec. facilities were paid quarterly in the amount of $119. per quarter. The association fees were $192. and now are increased to $254. to include the rec. facilities which was a $62. per month increase, their explanation is that their new budjet includes the rec. facilities, I also questioned that large amount of increase and how can they just "take over". I wish I could afford a attorney or get some help from the state of Florida or a organization in florida that governs this type of "double dipping".

Let them sort this out. You did what you thought was right. As long as you have proof for your payment, they can hassle over it.

Tell them you will retain a lawyer if they don't leave you alone.

I agree with Susan. The two entities need to battle this issue. However the Condo assn would have known that some members may have already paid some of the Rec center fees if they had negotiated this change with them. It's apparent to me they did not.
