40 homes of our 140 have backyard wrought iron fences, community property. These
fences are scheduled for paint/repair every three years. A letter went to each HO
with a 2 month notice that the painting was scheduled in Feb., leaving backyard
fences alone for the holidays. The paint vendor also left a note at each door,
I posted it on our website, and the gardner gave a very reasonable quote for those
wishing to have someone else remove folliage/Lattice work, etc. Yes, the PITA in
the community called the PM 2-3 days before scheduled date saying, "I don't want
my fence painted." They have a tall hedge and 18" doggie fence against the wrought
iron. The PM apparently had a week of phone calls back and forth...where the PM
claimed they would have to sign a waiver(???) ie...implying choice. When I questioned that she got snippy, refused to talk about it so I called the director.
Not the first nor second clash with this manager. The painter is returning Wed.
25th, 2 weeks after completion of 39 fences (nice job done)...but the Director and
PM said that another Notice needs to be "sent" to the HO/PITA. Do any or all of
you feel enough is enough. I said just call them (message machine and email them). I certainly don't want their small dog to escape, but who has this kind of
time for this stupid nonsense. As far as the BOD is concerned, both manager and
Director are on thin ice (yes, even in CA.)

If it were me, I would tell this homeowner that the fence will be painted whether she wants it painted or not! The HOA has an obligation to maintain these fences and that is what is being done. IMO, this is not something to negotiate.

It's a given it's not negotiable. I am more ticked off with the PM and Director than the PITA. He is always objecting........but I expect more for
our money from the Management company.

Well, the PM should be reminded that he is a contractor -- he is not a member of the BOD. He takes orders from the BOD whether he agrees with the order or not.

She is being replaced at our mtg on Monday. I refuse to continue babysitting
her and the issues. We have been working together for 2 years......our BOD is
patient........but the Director might be next (switch companies....?)
fear of going from frying pan to fire.

By saying "director" are you referring to a member of the BOD? If so, do you mean the remaining board members may be voting to have this director removed from his/her officer duties? To remove a director from the BOD would require a vote of the members, right? BTW, what did the director do? You only mentioned the actions of the PM.

Jackie - it's not a question of how would YOU have handled the painting of a fence section that had bushes and attached dog fence, it is how the MC did. They opted to give this resident extra time.

The big question is how it will get done (the painting).

Don't you have an ARC?

Looks like the MC and the Director are trying to solve this issue.

How about stepping back and letting them try to work this our. Maybe the resident will have to get this done by herself, using your painter.

I should have been more clear. Frustration took over. By director I meant
the Property Management Director, our vendor. (LOL)

You are always so balanced....I love when you respond. The fence will be painted, if I have to do it myself.....but the real issue I am trying to
tackle here is that the PM created the issue from the get-go by using the
word "sign a waiver" which isn't an option as we all know.....but fueled a
fire. After weeks of "nothing happening", they responded with " well, we still need to renotify them, etc, etc. The resident will do nothing!!

Mary's right. There's nothing to discuss, nor anything Ms. Doggie Fence has to negotiate with. Send your painter out and inform your PM his duties include following the directions of the BOD, not hand-holding with Membership.

From what I read on these HOA newsgroups, many assn's have these and many other problems with their mgmt co and/or PM. However, the smart BOD's get rid of them as soon as possible!

It seems the PM's are good for about 9 months, staff changes.......you want to be fair and give them a little time to "adjust".......and before you know it they are as bad(attitude included) as the last group you dropped 3 years
ago. Any So. CA. folks out there with long-term satisfaction 4-5 years?
