I have had many issues with my new renters below me, but the most annoying is the parking that this person just can't perfom. PM had been invovled, homeowner fined due to residents not complying with rules and the parking issues still continue.

I too own a small SUV and can not open my passager door. I have left a note on the drivers car stating since he can not park striaght that I can not and will not legally be responsible for any dings, scratches or damange due to his lack of ability to park straight. Actually the above photo above shows a better than usual parking job.

PM is seeking advice from our atty about towing at this point. I just don't know what else we can do?

Well, I guess he could really argue that he wasn't into your space -- the back tire is right on the line. Maybe it's my imagination, but are the spaces narrow to begin with? Perhaps you can convince him to just pull into the space instead of backing in. The problem may really be that he's not good at backing up!

Frankly I don't know how the board could justify towing a vehicle from a person's own parking space, especially if the vehicle really is in their space as evidenced by the picture.

Yes Mary, “the back tire is right on the line.” With most cars that means a further extension – 3/4 inch with my car. The tire is in the tire well and most cars extend past the tire. That car is in Francesa’s parking spot! If it is typically encroaching like that, the problem needs to be corrected. The parking spot shown is already tight and the encroachment perpetuates the problem.

Hopefully the attorney will be able to resolve the problem; assuming that the parking area is common area, the HOA, via the PM, is responsible to resolve the issue. IMO, fines should continue until the issue is resolved.

Francesca, I know you've been dealing with this problem for a REALLY LONG TIME. This picture sure "clinches" it. I hope the attorney can help you. I do not think it would be unreasonable for the Board to enact a rule stating that all vehicles must be parked "forward" in their space and that if vehicles encroach in another's space it will be towed...at their expense.

But I just thought of something else....I don't mean to be nasty about this but if your five or six feet are YOUR five or six feet, perhaps you could place something right on the line....but "on" your property in that parking space which would force that person to park within the lines? Perhaps park a bicycle or place an urn or build a fence (for goodness sake) on YOUR side of the yellow line....just something to point out to your neighbor that if they hit it, they're "over the line" so to speak.

I don't know if I'm making sense here....I'm just trying to point out that there must be SOMETHING to show that person they're "violating" someone else's space.

The issue with the parking is that this person who is parking in this space is not even suppose to be living here. I spoke with the landlord and .... the original tenant has moved out this last month.. Dec. He has vacated the home leaving his undocumented roomate living in the condo. They have changed locks and get this.. the phone is disconnected. The land lady stated she is going to be by tomorrow. To leave a note on the car and the door. Telling him if he continues to park in the parking space it will be towed. They are in the middle of an eviction.

It looks as if your problems may soon be over. There seems to be some action being taken. Patience is now the key. Please let us know what happens....

I'd be half tempted to set up a lawn chair in your space, grab a good book, a cooler full of. . . whatever. . . and wait for the tow truck.

I might come down and get a picture of the Landlady, not many of them around. Actually I think we all would agree, and who is parking there is irrelevant, the management must do their job and make matters right. That's the problem. I wonder if anyone has looked at the documents and checked to see if this is addressed specifically. I know our management has enforcement powers to fine and correct the situation in cases of this sort.

My god, of all the things you can do to your neighbor, mucking with his parking space is akin to running off with the husband or wife, and is some cases much more serious.
