I live in a condex only two units with no HOA. There is a trust in place naming an executor, my neighbor, as being in charge of the insurance policy plus rules for the common area (shared driveway, parking, and backyard)

We have been paying him direct and he pays the bil quarterly. He was giving us receipts.

He moved out 6 months ago and has been renting out his property, and left no forwarding info. We have been trying to contact him to make payment on the policy. He returned no calls.

Finally I found out through the insurance broker that the policy had lapped and was cancelled. He also lapsed on his personal inside insurance. The neighbor even took payment from us after the policy was cancelled and pocketed the money.

Well I opened up a new policy under my name and of course the premium has almost doubled. What recourse do I have.

He owes me for half the new policy but will never pay - plus he has renters that are trashing the property, violating some of the common area rules (four vehicles some being parked on the grass).

Yes - I have contacted an attorney but wont hear back until after the holiday -

My property is in MA.

It sure sounds like you need an attorney but meanwhile you can find out his new address by checking on line to see where the property tax bills are being sent.

Dan - in the future a third party should be set up to pay the bills. Having one side give the other cash is not a good idea. Get a neutral party to administer the necessary payments.

Looks like you are going to be responsible for a while for all payments that were shared before. Be sure to document everything - you may have to file a suit to collect the other half.

Don't be surprised if this unit goes into foreclosure. The warning signs are sure there.

Explain to me what a Condex is, please. It just seems to me that somewhere along the line, someone (developer.....owners....court house.... some has some recorded information of your existence and your operation. Tell us what you can and how you came to be,

For those that want to know. A google search of Condex turned up this which seems to me to be a good place to look for answers.

Most simply put, a condex is a former 2-family home or duplex that has undergone a "condo conversion". This requires changing the deed and legal description of the property. There may or may not be a condo-association, and any rules and regulations may be listed in the condo documents (usually referred to as condo docs). Usually there is no condo fee (but always ask!) except for Master Insurance policy that will cover the insurance for the entire building. The cost of this is usually shared between the unit owners. This Master Insurance Policy would cover the building structure and liability issues on the property. Unit owner would be encouraged to get some type Tenant/Homeowner insurance to cover loss or damage of personal property Landscaping, plowing, maintenance etc. is usually taken care of by each unit owner.

. . . the left side. . . and the right side . . .

No wonder this Original Poster is having issues.

It was just him and the other guy. . . until the other guy split.

As mentioned previously by someone, your best bet would be to see a lawyer.

I don't think anyone on this board has any experience with Condex Associations. . .
