We recently had election in our California HOA. I received the most votes (47),
the second most was 19 votes, but I'm the new member coming in. Our management company tells us that the newly elected members must decide the titles (president, vp, sec, treas...). I believe that it should be according to the number of votes.
Where can I find information under the California rules that says so?

Milton check your documents. More than likely the BOD gets to decide who gets what regardless of the number of votes.

Here's what ours says, look for similar language:

Section 2.5. Organization Meeting. Immediately after each annual meeting of members of the Association, the newly elected Board of Trustees shall hold an organization meeting for the purpose of electing officers and transacting any other business. Notice of such meeting need not be given.

That's about the same wording our has. It does not state that the newly elected is going to selec titles either. Can this be brought to the owner in the form of another vote? This time to select titles for elected members?

I know someone else who once thought that, too. Most likely, tain't so.

Check your governing documents, especially your bylaws. They should prescribe how the officers (president, vice president, secretary, etc.) are determined. In most HOAs the board elects the officers, and it doesn't depend on who got the most votes for the board.

IMO, the best way to do it is to select which person is best suited for which job. Sometimes it's easy; sometimes it's not.

No.

If your bylaws specify that the board elects the officers, then that's the way it's done. The titles of each officer position and their responsibilities should also be spelled out in the bylaws.

You must follow your bylaws. You can't do something different.

And you're not "selecting titles."

Milton - sorry bud, but this procedure is Board101 -

and if it throws you, I'd suggest that you take a year to participate as a "general board member" instead of an officer, in order to get up to speed about board activities and roles. You need some experience under your belt.

Normally the members elect the board members, then the board members decide among themselves who will hold which position (title).

I'm trying to follow your train of thought here. Do you feel that since you got the most votes you should automatically become president? Or do you think that since you got the most votes you should be able to decide who has what title?

I got the most votes but I sure as heck don't want to be president. There is someone else much better qualified to hold that position here. I like being treasurer (and have been so for four years) and I sure wouldn't want the person "with the most votes" appointing that position to someone who just got elected; and has no experience with our money, our budget and our bank accounts.
