Once a Reserve Study is completed, should it be readily available to any homeowner requesting a copy? Thanks. -ReneeD

Depending on what the reserve study says. Certainly it should be perused carefully and any suspect or personal information redacted. I can't see how it can be withheld if an owner wants a copy. I would assume the owners would be informed it was being done and they had some input it deciding to do the job. So, give out a copy as requested. You may also want to charge a fee for the service if it it a long report. This kind of thing bothers me. I know personally about condos. If a bank of finacial company is going to lend money to back a mortgage, they call the condo office and ask questions about the financial condition of the association, or they ask that a form be filled out. As far as I know they are given the figures requested. But let a homeowner ask the same questions and some organizations have a fit. I understand that the mortgage company has to protect their investment, but it seems to me, that some of this information is proprioritory. I can't see a solution for it as the owner has the right to sell freely and the buyer has the right to pertinent information.

Once the Reserve Study is approved or acknolwdged as a plan by the board, it becomes a part of the minutes as an attachment. You can request a copy and according to your state laws or documents, you have access to all legal records. You probably will have to pay for the copies.

What in particular are you looking for?

I would have serious issues with any company that has personal information in a Reserve Study. This is a report concerning the assets of the association not any people.

This is an association record and should be treated as any other record. Most places you must make this available to the membership. But I fail to see why the membership would need to put input into this. The decision is one belonging to the Board.

I would be glad if any owner asked about such from me. I would consider this to be an indication that they care about the welfare of the association. In fact, I would encourage its dissemination. The only reason to hide it is because the Board isn't doing its job.

As for the selling of the information who would buy it??? Our study lists the assets of the association and expected expenses related to their upkeep. (For instance it is expected that after 9 years we should expect to do some repairs to the walls.) It then discusses how to expect to pay for those repairs.
