I am seeking information on the legality and ability for existing board members to oust a president and other board members. We are on a board headed by an ineffective president and a board made up of non-resident owners (owners who do not reside in the condo complex).

We are facing very serious issues which are not being addressed by the HOA. Myself and another board member are very concerned and don't know how to force our president and board to act.

We would like to take over the board and oust these members.

Matt, I just posted the same problem, but I am in AZ. The first thing I would recommend is read your by-laws to see what your condo rules are. Then find the state law that governs condos. This group is a big help but you need to do some home work.

In fact, this is how rouge boards get started - no one pays attention to what's going on as long as it doesn't affect them personally (although it will sooner or later). No one wants to take the time to come to meetings and participate or ask hard questions, nor do they have the guts to make hard decisions, explain why and stand by them. Next thing you know, the HOA's a mess and no one knows how it happened. However your situation ends, I hope your fellow homeowners learn their lesson.

If you have an upcoming annual meeting coming up, now's the time to put a bug in people's ear to encourage them to come. At the meeting, you can express your concerns and see how the board members respond. Hopefully that'll prompt lots of questions from the audience and maybe some of the resident owners will be motivated and mad enough to run against them.

But be careful - it's one thing to get yucky board members out, but your problems will remain. You didn't say how many board members you'd like to see outta there, but whoever replaces will need to hit the ground running. Much of the burden will fall on you and the other board member because you two have the most experience.

First realize you are not suggesting a matter of minor importance or a matter that will not require a lot of work and a lot of time. In spite of your opinion the board has a record and a history, learn it. Next thing is to formulate some constructive change recomendations. The more support you have the better your proposal. It will probably turn out that change will be better little by little that upsetting the cart. This requires perserverance and more time. But, if it has to be done, do it.
I would almost promise you, if the board is run badly, the players don't know their documents, so, learn your documents better than any one else, some one has to lead, and you can lead using your documents.

Do not go to a meeting to overthrow the Board, go to the meeting to show the owners a plan for a better way to run the railroad. Have a plan for the future, have volunteers lined up to support your plan and if you can't get the job done, get some action to allow the process of self government to provide changes. Offer to work with present board and get them to accept your contribution.

If it don't work, them plan on a recall effort as described by your documents.
