we live in florida, and our community has 340 homes, our community is fed up with the board,
so to make a long story short, alot of streets, want to seperate from the current hoa and start our own,is this possible to do .thank you

The community can not separate. What you need to do is get rid of the board. Your community needs to become completely aware of your
CC&R's. You will find the answers there.

If you have "a lot of streets" then you must have some voting bloc power.

Approach the board and discuss the reasons for your disgust with them. OR Request a special meeting for the purpose of recalling all of them and elect a new board.

Study your current bylaws or articles for how to do that. (special meeting and removal of board)

It would be a whole, whole, whole lot easier to remove your entire Board than to reincorporate and form a new HOA. Follow the Florida Statutes on how to remove a Board. To start anew would also require much more expense and there really is no need to follow this route.

The Statute is 720:303 (10) Google it and it is easy to read and follow. But which ever way you decide to go, it will take cooperation from many of your members.
