what form do you use to file at the courthouse in texas when the association is taken over from the developer?

I'm not sure you need to file anything at a courthouse, but you usually have to file amended corporation papers showing a new board of directors and usually a new agent (address of record). That's usually with a whichever division of state government handles corporation filings.

I'm sure different states have different procedures. In AZ there are no papers to be filed when the assn is turned over to the members. Also, when the BOD members change that is noted on the annual report filed with the Corp Comm. each year - a doc. does not have to be recorded. I would suggest checking with the TX state department that handles corp. filings.

Joe is right. You only need to change the Registered Agent of the Corporation, assuming you are incorporated as a nonprofit corporation. In Colorado that form can be filed with the Secretary of State via the internet for $10.00. What is critical is to perform a transition audit (see attachment) and if changing management you may find the attached check list useful.

I am guessing that you don't have a management company. If you do, then it is their job to deal with anything that needs filed.

Here you will find the Texas Property Codes as they relate to HOAs. Specifically chapters 201 through 211. The trick is to figure out if the particular chapter applies to you. One day I will actually get that figured out.
