Have any other HOAs on this forum faced the issue of seeking reimbursement for an easement on your property for crossing your property for public easement (e.g., city sewer, etc.)? We are facing that issue now since a neighboring commercial property owner has been given permission from the city to connect his property to the sewer main on the other side of our property requiring digging up our road, etc. to install a sewer line. He will dedicate the sewer to the city for maintenance when completed. He has already surveyed and bluestaked the route. We are looking for advice on obtaining reimbursement for this utility easement from the commercial property owner and was wondering if other HOAs have faced this same issue and how you have resolved this. Any advice would be appreciated.

Bob,

We haven't had a similar situation, though you can bet Commercial's permits will stipulate your property will be restored at their cost. The inconvenience to you, however, probably isn't reimbursed. Asking to see a copy of the permits couldn't hurt.
