The board after much disscussion, decided to lock our clubhouse after 3 PM, our secretary is gone , the maintance men leave. We are giving each homeowner a key(one) if they want another a fee is charged, only fair. The reason for doing this is simple, the area around us is changing, we have people coming in the rec areas we don't who they are. I am only trying to "secure" a little more.Plus the card game players at night would be safer.I am having a problem with ONE man he is said each house should have (2) keys.I said it stands it was voted on month ago, his wifey comes and records all meetings and then he watches them and comes up with all these things we do wrong(BOD) he is not able to come to meetings, he is disabled. Now he is going to sue us, for what I don't understand! This man is and has been a menance all year, in which pretty soon I am going to SUE! HIM! Nothing in our doc about locking or securing any area so where he is getting all his info from. Out of 216 homes he is the only one complaining. Do I just ignore the "threat" because I hate to be threatened. My hair stands up !!!Have any of you r communitys had this problem...sorry about long letter, thanks LaVerne

I don't see his conflict - he has a key. Period. You are not preventing him access. Where in your bylaws or other documents does it say that everyone has a key?

(By the way, I find it amazing that the clubhouse is "open" to entrance by so many people! That would never work in our sub., but it's just a building (no pool, etc) We have 250 homes.

What's in your clubhouse that allows ALL residents access? 24/7?? Am I missing something here?)

Susan, our clubhouse has a library, small gym, billard room. Also you can get to pool area and tennis, shuffle board courts, etc..our bylaws are 30 years old! and yes we are working on re-doing them. There is nothing in bylaws or docs, this a BOD vote. Our clubhouse is beautilful and just bought all new furniture, big screen TV. I think I am doing good then to get people like this is just --well..Thank you

Just ignore him. He is just another one of those people who use the word "sue" as part of their daily vocabulary.

The next time that he makes that threat, ask him very politely, WHY? See if he has an answer. Tell him that the Board is just trying to make the clubhouse a safer place for all of it's members. Everyone has a key for access so there is no reason for him to go nuts on your Board.

What kind of key are you using? If it is the typical key you might point out that he could get a second key at Walmart for $1.00. Which is why I think if that is what you are talking about you have made a colossal mistake. Within six months keys will be floating around your neighborhood like candy. And it only takes one lost key before everyone (including the teens from another neighborhood) have a key.

If you are going this route, please spend the money to get a lock that uses a card key mechanism. Then you can log who has unlocked the door and when they did it. Your up front investment would probably be a few thousand dollars to include installation. The card keys themselves run from $2.00 each if purchased 100 at a time to $5.00 if purchased 10 at a time. (The cost will vary with the level of security provided as well as quantity purchased.) You should be able to buy a system that you could use lower cost cards today and then move up to higher level cards in the future.

As for suing this owner, you would simply be lowering yourself to his level. Further, it would likely be a waste of time and money because being a jerk is not generally an actionable behavior. You must show damage done.and making you upset won't count.

The board can set hours of operation (access) to this building, too.

Unless you have a person on staff during all the hours that this building is open, you are opening up yourselves to trouble.

The activities going on in this building need to be monitored! (Even if you are an over 55 group - if fact ESPECIALLY if you are an over 55 residential community!)

Kirk, we are using a high security key'MEDCO" it can not be copied. Yes we have a log on all the keys, and they signed for them. The key cost 17.00 each. I don't want to "sue" anyone. He (homeowner) said he will sue. For what I don't know. This man sits on the computer all day and finds things we might be doing wrong. I am trying to ignore him and maybe he will go away!!

Susan this is a 55 community, but it has always been open even when no one is there. It is their clubhouse. We all "own" it. We pay for it in maintance. But I do see your point. LOL,lol

Certainly one of the downsides of the Internet, including Message Boards.

But hitting the Ignore Channel key (F14 on my keyboard) is always an option, and sometimes will discourage whiners.

in the USA, a person can sue any other person for any reason at all. I can sue you, right now, for posting on this board. (I won't win, of course, but i can sue).

You cannot prepare to defend yourself against everything.

So, wait until he files suit and serves you, then worry about it. Until then, the advice of all the others here should be followed: Ignore him, be nice to him, ask him "why", etc..

I agree with your thoughts. I would ask him only one question and that is WHY? does he want to sue. He won't have a legitimate reason, therefore just ignore him. But he will have a reason, probably something very non truthed.
