Can HOA meetings be taped?
I know the laws in North Carolina changed somewhat a few years back in regards to HOAs but I believe that had to do with forcing foreclosures due to fines etc....
I can't seem to find anywhere that you cannot tape a meeting.

Thanks.

As far as I know here in FL the answer is yes. If your governing docs do not cover this issue then look up your state guidelines.

Thank you,
I've checked our docs & it doesn't say one way or the other.
Our state guidelines all talk about wire taps & phone recordings.
I can't find anything about board meetings being taped.

In Virginia meetings can be audio and video taped..that's if the association is a property owners association under the state statute.

The laws regarding wire taps and phone recordings are often where you will want to look. In some states you must notify every person who is being recorded that the recording is taking place. In other states, only a single person must know of the recording. (Texas is one.)

Bijoux,

As Kirk says, the state laws regarding wire taps and phone recordings is where you will find your answer. The law will not specify board meetings, but will apply to any type situation where a recording may be made of a conversation.

I would like to thank you all..............you were correct and I did find my answer in wire taps and phone recordings.
North Carolina is a "one party state" Just incase anyone else needs this information......www.ncleg.net......when that window opens go to the upper right hand corner of the screne.....you will see General Statutes, click on it. The next screne shows a box that says LOOK UP and in the box it says "enter chapter #" that's where you would type 15A-287

I hope it's okay to give this information.

Just so you know this was to find out if a person that is hard of hearing could tape a board meeting. The board was trying to stop an elderly person from doing so. Thank you all again.

I am secretary at an HOA and I purchased a recorder to record the meeting to help me with recording the minutes. No one objected and as far as I am concerned, that is the only way to verify what transpires at the meeting. Just my 2 unobjective cents. The recording is certainly the most "accurate" minutes of the meeting around.

Bijoux,

Tape recording an open membership meeting does not come under any General Statute or wire Tap regulations.

All one needs to do is to state at the start of any HOA meeting, that you will be taping the meeting. Period. If the Board says "no", then you need to o research your State HOA meetings Laws.
