It's been a while since I visited but pleased to report after lots of toing and froing over the years on our community I now find myself VP of the association. The rest of the members have been on the board for 12-18 months or so. My partner was VP and then President for 2 years so I do know the inner working etc but I have a small dilema and as a newbie on this current board I am getting the attitude oh we have discussed this before as a board yadda yadda!

I hope some of you more experienced folks can at least point me in the right direction.

It is a bit long winded but basically the rest of the board is being very dogmatic about a particular issue and it concerns roadwork being done outside of the community.

Our budget meeting is soon and I want to suggest we add more enhancements to the community, plantings, plams trees etc. in communal areas as we have plenty of cash in reserve but the rest of the board want to keep hold of all the cash (not a small amount either) incase we need to replace the front of our community after major roadworks which could take 18 months to finish. Now county own this land and surely the bottom line should be if the county digs up the grass verge and detroys planting or hedges etc. they should replace them and it shouldn't be at the HOAs expense to replace especially if we don't own the land!!

I am trying to find someone to speak to at County level authority but easier said than done! Any guidance about what I should do next?

What does the front of the community look like now?

Does your HOA have signs or any other items on this county owned property?

Susan, no signs as they are at the main entrance not affected by digging or roadworks, it is mainly the grass verge and hedging along the road that is being dug up for piping etc., the road works were in the plans years ago so the road should be wide enough already and not really affect the community as such, it's just all the prepatory work and possible construction damage further down the line.

The land is definately owned by county but the others seem to think we will need to replace it once the pipes are in but I just don't think this is the case.

I mean even if it was our land they still couldn't just come along dig it up and not put it back again. I just need to try to get the others to see this. We should be worrying about inside our community and not about spending money on county owned road outside!

The community managers employed by us have given advice in the past and I guess this is what they are basing their decisions on but I am just not convinced as they have a very poor record when it comes to giving correct advice which is why I want to be prepared with all the facts when I go to the meeting.

If you can not get in touch with the county, the only thing I would count on would be the county putting grass back in the place. They are under no obligation to replace anything extra that your HOA has added. And many government organizations won't replace additional items that you have placed there.

All the same, I see no reason to not consider doing some on the outside while being prepared to replace some on the outside when the road work is done.
