Our HOA has sent many letters to HO in violations. The problem is thats all the PM is during sending letters the Board have not came up with what kind of fines there should be. One board members say just keep documenting every time a letters is sent, another thinks separate fine are a no-no, another say add the fine on to the annual assessment some of these HO haven't paid dues in years the PM has place Liens on their home but we in this HOA have over $42,000 outstanding of non payments of dues, no reserve funds and chronic non payers and nay sayer people just aren't into what is going on in the HOA one homeowners violate then another and another, 3 years ago it was a beautiful subdivision with foreclosures, people moving in renters, HO want cut their grass, homes not painted I could go on all day and yes I am venting because I need advice on how to be proactive enough said thanks in advance. Jay - if your PM has place liens on homes, then you must have some kind of "procedure" that has been followed. Last step would be the liens.

Has the PM been tabulating fines, in addition to past dues? How do you know this has not been done?

If you have people who are not paying their dues, then first place a lien. Then if they still refuse to pay send a warning that you will foreclose and follow through.

Your Board needs to get its backbone and institute an enforcement policy. If you can't fine, then take the worst offender to court.

But first, you need to get the attention of enough people to get a Board seated that will step up to the plate.
