Our covenant states residents may have 1 single family dwelling with a detached small accessory bldg on residental lot. Our ARB approved a guest house, Is a guest house a small accessory bldg?

I would think not but does it say small building or does the covenant have dimensions in it? Because small is relative, if the main house is 5000sqft then a 1000sqft building is small in comparison. As opposed to: The building shall be no larger than 8' X 12'. Other covenants may also spell out whether or not such a building can be used for human occupancy; read all of your documents carefully because the answer may lie in different sections.

Besides HOA approval such a building for human occupancy will need any number of city/county building permits and a certificate of occupancy. Besides complaining to the BOD, you can file complaints with the building department asking that they not approve the structure. You might not win but it will cost the perspective builder all kinds of headaches.

From your other post I assume the ARB meetings are closed so do you know this was approved for a fact or is it something you heard? You can also file a formal complaint with the BOD asking that this project be halted and that they follow the CC&R's.

CCR's often say 1 single family dwelling but that doesn't mean you can't have guests over does it? Therefore a guest house doesn't sound like it violates the CCRs to me. When your kids boyfriend or girlfriend stay over in a single family dwelling does that mean they are violating the CCR's? If they stay over in a guest house I don't see a problem either. Guess it depends on who and what the guest house is used for and for how long. Some 'guest's' do overstay their welcome!

A "detached" guest house if certainly another residential space. It's not like a shed or garage or gardening shed.

Better watch this one. There is a real push for the "mother-in-law" suite or guest house addition to homes lately! Probably more, since we baby boomers have both the kids AND the parents coming back to live with us! Ugh!!

Seems to me the solution is in the property "zoning".
Single family means that. Attached means that. Small is irrelevant.
Residence does not mean "sleep over". Good luck.
