Is cleaning of the gutters an HOA responsibilty? There is nothing written about this in the By Laws or Declaration. I have seen other posting on gutter cleaning, but no states (that I saw) that the HOA is responsible.

Any advice on this would be greatly appreciated.

It depends on the ownership.

Who owns the gutters Melissa? If the homeowner owns them, it is then the home owner’s responsibility to clean them. If the HOA owns them that they are responsibility to clean them.

Do you live in a condominium? If so, you probably own from the interior paint inward and the gutters are owned by the HOA. If you live in a single family dwelling in an HOA, like I do, then I expect it is the home owner’s responsibility to take care of the outside maintenance of your home.

Donald - Ownership is not always the determing factor on maintenance responsibility. It is entirely possible for CCRs to specify that an HOA is responsible for the maintenance of something owned by the homeowner - I live in such a community.

If gutters are not mentioned in the CCRs, I would next look for a more genearlized statement that places "all not specified" items or maintenance responsibility with whom.

Failing that, Donald is likely to be correct in that ownership will determine maintenance responsibility.

This depends on what type of HOA you are in. Condo? Villa or co-op? Stand alone home? We should know that before we can make an educated guess. You also will have it stated in your Docs, who is responsible for what if this is not a single family/stand alone home. It will be listed under "owner responsibility"

Without knowing more it is hard to say. I live in a townhome and our docs (while not specifically mentioning gutters) makes it clear homeowners are responsible for their units and the hoa for lawns, treees, shrubs, etc. Look more closely at your particular docs.

The community is townhomes to answer DonnaS question. The By Laws and Covenants documents state the HOA is responsible for the roof, siding, and lawn maintenance/repair. I could not find anywhere stating who is responsible for the gutters, the docs are vague. Technicaly are the gutters a part of the roof? And I am not sure who owns the gutters....I am trying to find an answer on that question from the builder.

Does it say roof, roof structures and appurtanages? That would be the gutters. The builder wouldn't know unless he also is the Developer. That's the guy( developer) who had the documents written, where the roofs are addressed.

The gutters in a townhome is more than likely (without looking at your documents) the HOA's responsibility. In the communities we manage that are townhomes we purchased at Lowes, Home Depot or any other home improvement store gutter guards (not expensive) and had our handyman install them. It saves the HOA from having to clean them and in the long run saves lots of $$$$!

Hi Melissa,

Once this is cleared up, the board could consider including who is responsible for maintaining gutters, and other items, into the governing documents so that there is no confusion moving forward.

Our association, with assistance of our Property Management company put together a Maintenance Service policy that lays out who is responsible for maintenance for each item.
