I will try to make this as short as possible...I'm sure many of you have read my post and the trouble I have had and am having w/this Board..About me resigning, then volunteering many many times to get back on the Board, the President and her appointed clan would not allow it. The last time they needed a board member and I volunteered, the President appointed a HO who lives out of Town in Mass.,comes into town a few times a year...He was also appointed to handle the ARC (now how dumb is that)Because of local HO's persistance of me getting back on the board, I went after proxies and I made it March 31st as the treasurer.

The 21st of May, I received a e-mail from the President, informing me she was calling a meeting to have me removed from the Board...What brought all this on was the fact I requested approval to install a fence because of the two neglected (one forclosed) properties on both sides of me...I wrote the Board member out of town asking for approval, it was granted by e-mail w/stipulations that I must follow the guide lines and codes. He said it sounded nice and whould check it out when he came back to town. I hired a company that has been in business for over 40 years, the permit was pulled and untilities marked. (I don't live there)Sat. a week ago the fence guys showed up. A HO/VP went down there, told them it wasn't approved and chased them off....I did not even know this had happened for four days. The Board or MC had not bothered to let me know what had taken place.

I did e-mail the HO/VP to tell him, he had no business to do this or be on my property in the first place. Told him to take care of his on covenants that he was breaking....This is when I received the e-mail that I was out of line and about the meeting to have me removed.

Now why would they give this out of town HO the job, if they weren't going to except his decisions. He then wrote back, stating that if anyone needs to be ask to resign then maybe it should be him....What a mess but I still don't have a fence. No one has contacted me since.

I didn't want to be a smart axx but did the Board expect him to fly down here to see the permit, contractors license, workmans comp, etc and give his approval. He did what he though he should do, by giving the stipulations, it would be corrected at my expense it codes not followed.

I knew this would happen because this President hates me. I still don't have a fence and haven't heard a word from anyone. What am I to do? The VP's fence is two units down and two doors down in the other direction is another fence that has been there since I purchased in 2004. The fence company were just running a line from those two fences and mark mine.(back)This is undue delay and expense for both myself and the fence company, who had all supplies when they came out...Should I have my fence installed or what? We are both in limbo. I have already signed a contract and if canceled I would have to pay a 20% fee.

Try to separate these issues of you 1) conflicts arising from you being back on the Board and 2) applying for a fence permit with approval from an absentee committee head (He's the ONLY one on the committee??)

Your board needs to tell you why, as a resident, you are being refused an AC APPROVED fence. If you don't get an answer, put it up and make them prove it's not been done right, according to the AC.

You followed proceedure for approval. You have an email approval from THE out-of-town ARC. (How strange.) What are you waiting for? Meet the contractor there and if this VP tries to run him off again, call the police.

Sidney I mean this with no disrespect but if half of your tales are true and the people living there put up with it then they're getting just what they deserve. Yes I know half of your property is absentee landlords but what you're describing affects those people most of all. A well run HOA with nice amenities would allow them to make more not less money even if the monthly fees went up. They pass them along to their tenants the same way businesses pass their costs to the consumers. And elderly residents they're bigger sticklers for rules & regulations and doing what is right than any other group I know of.

I find it disingenuous that as a BOD member you didn't know that there was an ACC form to fill out or that written approval was needed. It's basic CYA especially if you're such a thorn in the president's side. She can't remove you from the BOD, maybe from the position you hold but not from the Board itself, only the homeowners can do that; unless your documents state differently.

What difference does it make if the ACC is out of town or not? You send him the application properly filled out and he sends back an answer yes or no; or gives you the modifications that must be met to gain approval. It doesn't take any longer to send a letter from state to state than across town and sometimes it's quicker.

No ones probably interest in what has gone on since my last post. I have been really busy...I first went to the fence company and gave him my plat and pick up the permit. From there I went to the County Clerk permit office. I ask to see the permits pulled for the busy body VP..I ask them to pukk his 20x20 Flordia room and also his FENCE...There was none and it wasn't even foot printed on the tax appraisers site..The inspector was going to the property today, I'm to call tomorrow to see what was done....It is on the foot print now, actually went on last week when the whole site was updated...I had sent a letter reposting them...I just hope there will be a fine of some kind and pay back taxes for the 3 years these additions have been there....

Sometimes it doesn't pay to mind someone elses business....And my fence is going up, the way I want it. If the VP can do as he wants, so can I and I will....I also found another fence kinda like what I wanted..The back dropping down to four feet only this fence back is made w/landscape timbers and no gate...We require shadow-box which is what I'm doing.

First things first, put the fence up...you followed procedure, you have approval from the ARC head. Just make sure you have a copy and save the email and save it to a disk, just to be safe.

Put your fence up, talk to your fence company, give them the approval letter and tell them to call you if any trouble arises. Bottom line, it is approved they can do nothing about it as long as you build it like you said you would.

Brad...that's exactly what I'm doing...I called the fence company and told him when ever he is ready again, so am I..but to call me first so I will be there....I was so hoping that the VP/HO would get a big fine or something...never going to happen. I was at the TH today the the code enforcer showed up (the VP or his wife wasn't there) so I walked over and told her I was the one who had ask for proff of permit, which there had never been one for either...What she told me, I wasn't happy,it has been up too long (3/4 years) so there was nothing they could do. I was so disappointed. It burns me that he would cause me all this trouble, when he knew he had broke all the permit and inspection laws.

And to think over all this, because I e-mailed the VP and told him to mind his own business and stay our of my yard...I said a few more things but no bad language or name calling....He went cry babying to her...the next letter I received was telling me, "I am calling a general meeting July 14 to have you removed from the board" this from the President....the HO's may not realize it but they couldn't have any one better then me watching their back.

I did know this, the fence company was able to install quicker then I had thought. This dumb Board gave this ARC job to a out of town HO..I had everything he ask for except this "form" you are talking about...I told him exactly what/how I wanted to do the fence...he must have understood, said it really sounds nice, can't wait to see it when I'm in town. SO THAT WAS AN APPROVAL...if the Board didn't trust his judgement, they shouldn't have given him the job. And they should never have over rode his judgement....Since all that I have copied everything made up a packet and it's on his way....I did go by our "so professional" PM and ask her for a form that I was suppose to fill out. Her reply, "I have none, ask Rob (ARC). I thought I had explained, all of this was only because it was "ME"...

Sidney as a Board member you should know exactly what is required and if you are a thorn in the side trying to do what's right and make sure the BOD follows the CC&R's and FL law; then you should especially perform the basic CYA and make sure every i is dotted and every t is crossed.

You have uncovered a real problem with the Board's governance - and YOU are part of that Board.

Clearly, your Board does not have good procedures for your homeowners to follow. (You found that out yourself) AND it appears that Board members are not following their own rules, or being given preferential treatment.

Time to get a better Committee, and get this straightened out.

It's only going to get worse.

At the next meeting motions (without going thru your entire story) that a new committee be established (with HOA membership involved, not all Board members) to re-write or clarify all guidelines and make sure procedures are being followed.
