I need some help here...Because of the two trashy units on either side of me, rotting door frames, nothing but weeds, black mole covered patios, etc. (two years), we finally decided to put up a fence. We were hoping for some good HO's who would perhaps go halfs on the shadow box fence...Well, it didn't happen.

We hired a professional fence company, he measured and was due to come out last week....Well, he didn't show (or so I thought) so I called. He told me him men were there Sat. and was stopped by a neighbor who also happens to be the VP...He told them it wasn't approved. They left...It was only today I found out about what had happened.

I have told you guys in many post how this Board would not let me on the Board because I called them on so many things they have done against the CC&R's (taking money from reserves/not funding reserves in over a year, no care what so ever to the common area, etc)I finally took your advise, I went after proxy's and am now a Board member. But in the meantime, the President placed a HO who lives in Washington State to fill a vacant spot (to keep me off)and she also made him the ACC (committee of one)

I wrote him for the approval of my fence and told him exactly what I wanted to do...he replied back telling me it sounds good and he would make sure he would come see it when he is in town...Does this sound like an approval to you..it did to me.

Well, I called the fence company and was told the above story...The MC/Board all got copies of this e-mail which sounded like approval to me but the MC took this VP's word that it wasn't going to be build right. Neither the MC or the Board let me know this had happened...The PM said it was the fence company place to inform me..I feel just the oposite..it was the MC's first responsibility since she had gotten a copy from the ACC guy.

MY other problem is that this man (VP) went on my property and ordered them off...I feel he has no right to be on my property let alone chase any one off. I did have approval but even if I didn't, I feel he still had no right, that if it was done wrong, I would be the one to face the consequences....Am I right or wrong?...Shouldn't the MC notified me that this Board member had run them off?...Has he the right to go on my property and do this?

The VP didn't have the right to enter on your property and stop the work but in the long view he may have saved you a lot of money. A call to get permission to build a fence usually don't meet the requirements of "submitting proper written request with plat plan showing elevations and locations of fencing". Sounds like you still have some fence mending to do with your neighbors over past conflicts. Everybody has to comply with the rules, even board members.

StanM.....I have the plat plan and so did my fence man...We are TH units...I was just following what this VP and other HO's had done. It's only two straight lines down the sides and across the back..I did want the gate in the middle of the back....there is nothing that says the gate must be on the end and the one two doors down had a gate in the middle.

The funny thing is that my lot backs up to the woods (not our land) There are six units to my building. I am the 3rd one down, no fence on either side of me but one on the end (the VP's) and the other two doors down the other way....The VP said the gate had to be on the end or the side? (so he wants my gate to open up into the neighbors yard, how dumb is that?) so the lawn maintenance could get in the yard...now tell me what that has to do w/anything...he said because the mower couldn't get in other wise because of the growth behind....Well tell me, if theres growth behind the rest of the fence, how is he suppose to get to the next unit in line...duh!!!...Not one fence is cleared behind their unit except mine...we have worked hard to clear it out, 4/5 feet, mainly for a fire buffer. The VP has no gate in the back, he placed his up front...so the lawn guy has to go in his yard and all the way back out and around the six units and enter from the other side to cut the other units...

"Everybody has to comply with the rules, even board members" I would say it is this Board member that has gone against code...The ACC appointee aproved me in an e-mail. If he wasn't capable of the job, why did the President give this responsibility to a man 3000 miles away.....He has appointed his self KING.
