Since you all have been so helpful in our HOA developing a Rules & Regulations document, I have another question:
We have a Violation notice for infractions of our CCR's, with a first reminder that the infraction may be an oversight. Both Notice specify the Article and Section which the violation falls under, timeframe for remedy, legal process.

1.If a violation is against a Rule rather than the CCR's, how is that addressed?
2.Does another Notice need to be developed covering Rules violations?
3. What about timeframe for remedy of Rules violations?

None of this is discussed in our CCR's. Just the authority given to the BOD to develop Rules and it ends there.

Every time I think I understand the process, something else comes up that brings further questions....Our BOD Mtg is Monday, and I thought I was prepared, but now I am not so sure.

Help would be appreciated.

No, you can use the same notice, just cite the specific rule. Since the board had authority to adopt rules by article of the CCRs, those rules hold the same weight as the CCR restrictions.

I saw that I just asked this same question on another post.

I will suggest adding the Rules verbage to the CCR notice.

We'll see how that goes.
