Does anyone know the percent of homeowners to change the docs? Ours are 30 years old and need a do-over badly. I hear 100% which does not sound right, because we will never get 100%. Then I am reading 51% that is in our docs now.I know we need this ina election od BOD members.Thanks.

To redo your entire Documents without any changes is just by a vote from the BOD. BUT!!! if you are going to change any wording, and I mean even if it is one single word, then that is considered an amendment change and according to your Docs, it must be 51% of the membership ,voting to pass the changes.

The State of Florida says "unless the governing documents states otherwise, 2/3rds of the membership" is what number they use. My condo association just redid theirs and it was costly but worth while as it reduced the pages significantly and removed all references to the Developer. They also removed the paragraphs that refer to Mortgage holders having a vote. There isn't a bank or lender in the country who gives a rats butt if the association changes things too much. It is just excess bagage for documents and if you ask a lender if they want to allow trucks or budgets to changes, they don't have a clue as to who will answer the question.

PS. Tennessee is AWESOME
