I am a homeowner of a small newly established neighborhood of about 40 homes (built 2003-4) here in Houston Texas. Our HOA is named Oak Park Ridge Section III. I dont want to bore everybody about the details (which I'm sure my HOA issues are run-o-th'-mill) with this at the moment but, as a concerned, invested homeowner, I would like to find out where I can start my search on HOA's board member requirements, responsiblities, rights of homeowners right-to-know...etc.

Im sure it varies State to State.

Absolutley ANY advice would be great! This has actually affecting our neighbors relationships which is a bad thing being how small we are. Issues ranging from: Non-payment of annual dues being paid (some are 5 years behind), homes that are now vacant and for sale for years here ( issues with keeping up with these yards ie: grass cutting), a self-assumed HOA president who talks a big game with no action as well as his micro-management of the treasurer duties ( who just happens to be...or was my wife as of yesterday she quit after our HOA president's lack of respect with yelling and demanding at his desire for the second time, hap-hazard meetings and so on......

Whew, Im getting all bent outta shape here. I thank-you for your time!

Concerned and worried in Houston,

Board duties are listed in the bylaws.
Does your state have HOA or condo statutes?
Contact your Attorney General's office and ask.

Order of rank of authority:
Federal laws
State Laws
Articles of Incorporation
CCR's
Bylaws
Rules and Regulations (board passed)
parliamentary procedures.

To find "typical" Board job descriptions, just google what you want to find out, i.e. "non profit treasurer role" "Board of Directors roles"

William,

The answers you're looking for most likely will be found in your governing docs: articles of inc., bylaws, CCRs & any board-adopted rules & regs. Also, you may want to research TX HOA laws.

If you have any specific concerns, we may be better able to help you out if you can give some background info and state exactly what your concerns are. Please state whether you live in a planned community or a condo.

CC&Rs are: Deed Conditions, Covenants and Restrictions, and may be called/titled anything from "deed restrictions" "homeowner covenants" "deed covenants," etc.

Connecticut calls them "The Declaration" (meaning the declaration of conditions, covenants and restrictions).
