Donna--you out there??? On a previous post you made reference that there is already a Florida State Statute that addresses owners losing their rights if they're "not in good standing". I poured over the 718 condo statutes this morning. I can't find it. Can you help me out here? Or is it only for HOA associations. Thanks for always helping! You're a gem on this site!

Donna might be busy this weekend, dunno.
You are correct, suspending the use of amenities and voting rights will not be found in Chapter 718.

However, Chapter 720 (Homeowners Assoc)does address it (#720.305)and speaks to suspension for a reasonable amount of time (whatever that means!)for use of common areas and suspension of voting rights for non-payment or 60 plus days delinquency of same. Both of these statements have the proviso "if the governing documents so provide".

To answer your question, Ann's post was right on. Chapter 720 of the Statutes has the member in good standing paragraph for HOAs, Chapter 718 does not have any at all. I think that you were a condo assoc? I hope that my memory is correct. The Not For Profit Statutes does NOT address this subject and that would have been your other resource for an answer.

Anyhow, I am going to be off of the computer for a couple of weeks because we are relocating to a beautiful area near Chattanooga Tn. Luck was with us on our selling of our home but I still have Flodia connections in 2 rental properties. See y'all soon. Donna
