Does a condo have the right to deny a unit owner to lease a unit if the unit owner is late in paying assessments? Our docs do not say anything...Is there anything in the statutes?

Late in paying assessments does not deny an owner from their rights. They just are getting late fees for being late but as long as they pay in a reasonable time, you cannot deny them from renting out a unit.

Now if they are not paying at all, and IF the governing Documents state, then an owner loses their right to vote and become a "member not in good standing "and that is when they lose rights according to 720;305. But to deny them the ability to rent would be a question for a legal person. You say that it is nowhere in your Association docs so why are you asking?

Let me get this straight, this person is late paying their assessments, they are trying to lease their unit to make money and your associations wants to stop them from getting money which could potentially pay his assessments?? I don't think your HOA has that right.
