I am a board member and the president of our HOA does all the code and she has 70 Violations out of the 70 she has sent letters to 35 of them stating their lawn needs resodding. She then goes and solicites the homeowners stating her husband will resod their lawns. This has been going on for some months now and the homeowners are starting to complain. Myself and other Board Members feel this is conflict of interest as she is making a lot of money from our community. Is there anything we can do to stop this. We do have bids come in on other projects and she is the one to open them and then her husband undercuts all other bids. Please someone tell me if any of what she is doing is illigal.

It may be legal in your state; it definitelt has ethical concerns.

It is clearly a conflict of interest. A blind man could see that.

if he does this by bidding AFTER seeing the other bids, it is wrong. If he bids with the rest, then he's just lucky or cheap. The process should be done in a board meeting, however, not in secret.

as for the other, probably not illegal, but unethical is very likely.

WHY is one person allowed to "do" all the code violations?

That should be a Board directive, each case voted on individually. The secretary should be writing the letteer to the Homeowner.

Your BIG problem is the PERCEPTION that the Board - thru the actions of the president - is setting itself up to make money.

You must stop this ASAP!!!

Depending upon what the FL laws are on conflict of interest it may or not be against the law. However, it is highly unethical. Why does the board put up with this? SHe should be made to stop this practice immediately. Being pres. doesn't give her any more authority than the other board members. This happens all too often. Many board members feel they can't dictate to the board pres. and the pres. can do as he/she chooses. This is not true! You need to talk with the other board members and set this Pres. straight NOW!!

Where are the other board members? She is only 1-vote, President does not give her more power then the rest of the board. The other board members need to pull her in and speak to her about this.

Review your covenants. Most contain language about how to remove someone from the Board.
