There is group of homes in the 2nd phase of our community. On this one cul-de-sac street stands a tree in the middle of the cul-de-sac where you drive around.

The tree sits in a circled off concrete area measuring about 16x16 as well as a fire hydrant and a small city sewer lid. Its all dirt and looks rather unsightly compared to the other phases. Every time I drive this area, I think we do something.

I guess the first thing to do is determine if this is consider common area.

Although we have not had any complaints, shouldn't this be a part of ground maintenance as well.

Has anyone had similar issues.

Sure sounds like a common area to me. I live on a cul-de-sac and there's an area just as you've described at the turn-around end. We have a tree in the middle ringed with bushes which is maintained by the assn's landscaping company. Perhaps you can suggest to the board that this area could be better maintained by the landscaper. Perhaps a few flowers or flowering bushes might be added to spruce it up. Nothing ventured, nothing gained! :-)

My most educated guess is that the tree island is common property. Someone has just forgotten or ignored it. Write a letter with copy to the entire Board, a landscape committee and the property manager if you have one. Send it to everyone who lives and breaths with association responsibility. Include a suggestion or two. Make it positive and stress how it will enhance that area of the developement.
