I live in a subdivision of 43 lots 7 full time residents,we travel 1.1 miles of a roadway that since 2001 is owned by the third POA, the prior 2 failed probably due to the fact all common areas were in horrible conditions. This developement started in 1970 before all these laws that are in place to protect residents from failing to properly make roadways passable.
Stated above the prior POAs never included the area I live in to be part of their POA, The only thing I can think of is that they were undeveloped lots with bad roads no one traveled these roads, 30 years later roads are still considered unsafe, thats the comment I got from the FEDX driver refusing to deliver a package to my residents. The current POA never asked us to join nor were we notified that one was forming, I would of loved to join, and get the ball rolling on getting the roads passable. Well they notified me with a bill claiming for association dues. I don't belong to one, but have to pay dues!!! Since now they reworded the bills maintenance fees. But they want to charge me the same as a member but have no say or vote. I tried to bring this up at a borough meeting but the concils lawyer is the same lawyer that supports the POA. The Pres. of this council said I will try to set up a meeting between this POA and us, at that time this solisiter said thats not going to happen. Beeen speaking with our state rep, he said he will set a meeting with the borough, that hasn't happened. When we reached $1000.00 of dues they took us to small claims and lost. they appealed then we appealed, now i'm guessing we've spent $10,000.00 between us. That money could and should of done something for us rather than this. I just recently attended their public meeting 10 people showed up, 3 of which were us, they said they were burn't out and need help, there are only 5 board members since 2001, because they own 6 miles of roadway I traverse 1/6 and others travel 3/10 of a mile they want full share but no vote. I'm sorry about the long rant. Pennsylvania SOS!!!!

SOMEWHERE there needs to be a statement about WHO or WHAT has jurisdiction (and responsiblity for) your roads. If you and your immediate neighbors need to form an association and get your roads at least graded, then do that.

If you are under the umbrella of another HOA, then you need to get them to be responsible for their assets (roads).

There is also the option of turning over the roads to the local municipality (IF they will accept them) and IF you and your neighbors actually own them.

In any case, prepare to have costs.
