Really just how acceptable is this? I know as I haves seen this occurring. It isn' the biggest law to break but it is a concern! This one has been seen on his patio lighting up a doobie, his co board members are aware of this. Does this make the HOA look bad?

Is it against the law in California? Then he is breaking the law. Do the police go after this kind of user? I don't know. Can you enforce against him when he is within his own property? Probably not. Does it make your association look bad? Only if you smoke with him. Tammy, even tho he stinks by doing this, you and your association are not responsible for his dumb behavior so unless he or it becomes an association problem, you might have to let this go. We cannot control what other humans do to themselves.

I appreciate your response. It is an odd subject isn't it? I can't believe how ignorant some single dads of a 15 yo can be! The habit of his explains alot though.

Tammy, you might want to tell this guy that his behavior is being observed by many people, and he could get recalled from the Board for immoral/illegal behavior. His behavior is provocative, at best.

If someone was shiplifting in public all the time, would you recall him from the Board?

I had to laugh at this one --- compared to some of the things other board members do, this is relatively minor. {Passing one around at an annual meeting just might make it go a little nicer). My first job as a manager and my task for each board meeting was to bring a case of beer for the 3 board members (the association didn't pay for it). What the guys does on his patio is between him and the law. What he does at board meetings is your concern. Who knows, in CA, it could be medical. Well, it could........

Joseph- Might even ensure there is a quorum at the annual meeting. But someone had better bring refreshments.

Since it's CA, it might be medical marijuana. He's probably doing it outside becuase of his 15 YO daughter.

A friend of mine has Parkinson's Disease and one of the drugs his doctor prescribes for him is marijuana. Here in California, the marijuana laws are all confusing, just like the drug itself! Federal law says it's illegal but there are all types of California laws that allow it to be grown, possessed, sold or used under certain circumstances.

Since you're in California, it's impossible to know if this guy is smoking it "legally" or not unless you bring up the issue with him.

He isn't smoking anything legally.. he offerred another board member a hit off his freshly packed bowl of Mary Jane... and the person he knowingly offered it to.. is lets say a mandated state reporter.. perhaps a SOCIAL WORKER!??

If it bothers you that much, drop a dime on him, with the law and not with complete strangers on an internet forum who don't know and don't really care to know the guy.

Seriously, we can't make you feel better about it, so perhaps turning him in to someone in authority might.

I certainly would question his judgement and his decision making capabilities. As someone previously said---board members of ALL people should be setting an example. I personally don't care what someone does inside their own home; but when they take it outside, in front of anyone and everyone it becomes everybody's business.

You could send him an unsigned letter, stating what "people" have witnessed him doing that and ask him to either stop, or address it publicly at a board meeting. It certainly isn't "conduct becoming of an officer".

I am with Joseph on this one and had to laugh as well...is this really a huge concern? Is it really clouding his ability to be a board member? There are many people in this world who do many things that if we knew about we would cringe. This guy just doesn't seem to care who knows his business, he isn't trying to hide it. Is he any worse than the business person who is on a board and goes to a bar one night, has too much to drink and then drives home?

Unless he shows up to meetings high, let the police worry about it. As someone said if it bothers you that much turn him in.

While in bad taste and illegal it also sounds like you are just blowing steam off. If it bothers you talk to him and tell him so, if you don't like him tip off the law enforcement. Come on, didn't just have a President of the United States who was smoking marijuana... he just didn't inhale.
