What is your opinion on this issue? Should it even be an issue?

We are in a gated community therefore the streets are private and belong to the Association. I am reasonably sure that ATVs are not allowed on public streets since they cannot be licensed in the state. We have several people who drive them on the private streets. I have no idea about what type of insurance issues there might be for the Association.

Do you think they should be banned? More importantly, should there be any effort to raise this subject to the board?

Of course if it is banned, how does it get enforced?

a private street and the organization that owns it can ban any vehicle they want. They can ban red cars, blue trucks, or even require that all vehicles have three wheels and polka dots to enter.

as for enforcement, the same as any other covenant... you find the violator, and fine the owner who controls the actions of that person.

Does your local police dept. patrol your streets? Even though ours are "private", they are under jusrisdiction (in terms of enforcing speed limits, etc) of the local cops, whom we ASK to come into our sub.

We have a problem with golf carts and gangs of kids driving those around. The cops will stop them if they see them.
