Can you have a HOA if there is currently only 1 member and his is not designated as a position?

I think your question is can you have a board with only 1 member. The HOA if formed when the developer filed the Articles of Incorporation and the CCR's.

The answer to your question is "Yes!" If no one else has stepped forward to run for a position on he board and, or, all the other board members have resigned or their terms have expired and only one board members remains, then, HE/SHE is the BOD. And that is regardless of whether this one person held an officer position or was just a director. Many assn docs state the board has the authority to appoint members to the board to fill vacancies. If you docs have such a clause then this lone board members should do so ASAP! Oftentimes an individual doesn't want to run for a position on the board but will agree to be appointed.

Yup, did it for years with 2, and AFAIK, the HOA is doing it now with only 1.
