Hello everone,

I need help ! my community in Baltimore county Maryland wants to call a special meeting and also wants to remove a couple board members. We need templates for the forms we need to distribute throughout the community to have signed. We are not getting any help from our property management company on this matter and my searches on the internet have not been successful. Any help or suggestions is appreciated.

Believe it or not, your "template" is most likely within your governing documents.

Somewhere, either in your bylaws or your CC&Rs there is detail regarding how to remove board members and how to call special meetings.

The paperwork needn't be very fancy, as long as it complies with your governing documents.

JohnF, it appears you need a better management company. Your By-laws should define the process. If not and your HOA is incorporated then look to your state's Nonprofit Act for guidance. Usually the President, or a certain number of Board members, or the Association members can call a special meeting. The Association members can call a special Association meeting by circulating a petition and getting a certain percentage (10%, 20% or whatever is defined).

The body (of people) who voted in the Board are the ones who will vote them out. So you need to study your documents to see HOW the Board got elected.

You don't say if you are a condo group or a residential association. The voting procedure may be different.

If your bylaws don't contain the actual steps, you can go to Roberts Rules and read them (Chapter XX - Removing a Board member) IF it states in your bylaws that you follow basic parliamentary procedure.
