It recently came to my attention that our HOA was not following the % of ownership guidleines with respect to the correct monthly dues each unit should pay. It clearly states it in our covenants and the the condominium act is very clear about this matter. So, everyone in the community is paying the same monthly dues. Prior assessments were incorrect for all the units.
A current board member stated it was not a big deal in it only $10.00 a month and we need to vote on the matter. I disagree. It is unfortunate but the Board should enforce this measure. So, far it has been 45 days and nothing has been done. This current month I plan on paying what I legally have to. Frankly, I expected them to send out a letter to inform everyone of the historical error but nothing yet. Comments please.

What are the billing you and what do you think they SHOULD be billing you?

What do your documents say specifically regarding % ownership? I don't live in an COA, I live in an HOA and all our lots are assessed at the same amount, regardless of how many "owners" one lot has.

I think we need a little bit more information from you.

Our HOA documents that we have an undivided interest in the common elements and expenses. This percentage is broken down in an exhibit which states what each unit will own and therefore pay each month.

Your Apportionment is set when the units are first sold. They are reflective of the value of the each unit devided by the total value of all the units. Add them up they total 100%. They can only be changed by a vote of 100% of the owners, which means never really.
There is absolutely no difference in calculating a 1% share or a 1.3 % share. Whoever said to forget them is a dangerous person to be making decisions. Just tell them to do the job right and show them they are the ones being "picky" and you are the one right.

I would also look closely at other things they consider not important. I hope you take an active interest in your association, this is just not one person that is acting irresponsibile in your association.

Tell the Board, "It is not your money." The money belong to the owners, not the Board. Also make sure your votes are apportioned and counted that way, any assessments the same, any insurance the same and any distribution of monies the same.
