Hi:

Does anyne know if there are special rules regarding a public pool in an HOA. I am trying find out if we can have the pool opened in the evening, after dusk, and what the regulations are for lighting and saftey.

Does anyone know where I can find this? This is in Palm Peach County, FL.

Hi Pat,
Your pool is NOT a public pool. It belongs to a private organization called your HOA, therefore, it does not have time requirements other than those set up and agreed upon by your association.

Safety and lighting might be under your Palm Beach County Building and Safety code Dept. Call them if you need those answers but if the pool was approved by the building and code inspection, then they no longer will have anything to do with how you operate.

I'd agree with Donna's post; your HOA pool is NOT a public pool; it is owned by a private, non-profit organization; the general public is not entitled to use it. Your HOA Board of Directors will set the pool usage rules and hours of operation. That being said, however, some cities DO have outdoor lighting ordinances and codes that must be met. Also, consideration should be taken regarding those residents/members living nearby (if applicable). The Health Dept. may also have stipulations or regulations regarding community pools.

I should have said it was not a private pool in a homeowners yard. I have contacted PB County to see if there any lighting requirements.
