Presently our CC&Rs allow two choices for roofing material; wood shake and tile. While several homeowners have re-tiled their roof most homes were not built to sustain the weight of tile. Wood shake is an extreme fire hazard and no longer covered by many insurance carriers. Due to improvements and innovations in roofing materials our BOD is considering ammending our CC&Rs. Has anyone dealt with this issue before that might offer suggestions?

Frankly I'm surprised the homes were not built to sustain the weight of tile, since the developer chooses what the CCRs contain!!!! What type of roof was put on the homes by the developer?

It appears an amendment to the CCRs is definitely called for. I would suggest the board write a letter to the homeowners outlining the hazards of wood shake and tile roofs. Include a proposed amendment and ask for comments. Then a special meeting would be called to vote on the proposed change to the CCRs.

I'd have to do a little more research but most of the homes were built with wood shakes. We don't have a developer as all were custom built homes. My worry is that what about the people who have already put on a tile roof? I am sure they will have complaints about having to undergo the cost to restructure. And, in the meantime there have been at least two homes who went with a tile "look" but it's made of a different material. Our cc&rs have been loosely followed in the past.

I would hope that those homes would be grandfathered in! We're working on an amendment to a bill at the AZ legislature this session that would require an amendment to the CCRs which changes any architectural guideline be grandfathered. To me this is a given, but some boards are so zealous in their duties they would require a member to spend thousands of dollars to meet the new requirements.

We have helped HOA's amend their Declaration of CC&Rs on roofing. IMO wood shakes are a very poor roofing material; plus insurance in our area is up to $200 more per year. Light-weight cement tile can be used rather than regular weight cement tile. In which case strengthen the roof trusses is not required. However, the light-weight cement tile is more expensive and breaks easier. For the past 10 years I have preferred stone coated steel with a life time warranty. Also, in the past couple years fiberglass/asphalt roofing materials have become more acceptable when there is a three demensional appearance based on aminimum of 320#/square and minimum of a 40 year life.

Following is wording we have used:

Roofing materials allowed are cedar shake shingles, regular and light-weight concrete tile, stone coated steel, slate and other roofing materials which from time to time may be approved by the Board of Directors. All roofing materials require approval by the Design Review Committee. Approval shall require materials of high quality and an appearance which is in harmony with roofing materials on other houses in the Association.
