John, not only is Roger fantastic, but the law firm Hindman Sanchez is here in the metro area (far west Arvada) and has free seminars to homeowners and HOA volunteers that you can attend and get more info on Colorado laws. Also the local CAI branch has been a great asset for me personally as well. HS is also a site sponsor I believe.

Property election of HOA board members.

I am new to the forum and am a ex-board member and am still very active in my condo community and attend just about all annual meetings. Our last election kind of took me off guard and to be honest I felt it was not above board with the voting of elected officials.

1. At the meeting they introduced the current board members and presented the President and a wanted to elect a member at large. The current VP position was up for re-election and it was someone who had moved out of the community but still ownes his unit.

They took a vote on the position without telling us who was running for VP and President and they said they had not decided. I have never witness this before. The community did not have a say in who went into those position we just voted blindly. Is this exceptable?

2. Is it acceptable to knowingly elect a board member as President or Vice Presidnet knowing they no longer live in the community but own a unit?

3. Can the switch position even if someone is not up for election. It looks like the treasurer is also the President. It does not specifically say you have to live on the property but it has been the understanding of every elected offical that has been on the board in my 10 years on the property that you must leave your position if you no longer live on the property.

Can you comment on these questions. Thanks Cina

I'm confused! You say you voted blindly not knowing who you were voting for. Could it be that you were just voting to determine if a member-at-large position should be added to the board? You also stated the board said they had not decided who would be Pres and VP. Many associations only elect directors to the board. The directors then choose (elect) who will serve in the various officer positions. Perhaps this is how your assn is set up. I would strongly suggest you thoroughly research your gov. docs. to determine what positions are to be elected by the members and, most especially, how elections are to be conducted.

Regarding board members living outside the community: Since your docs do not specifically say all board members must reside in the community, IMO, as long as the individual owns property they should be qualified to hold a position on the board. Not living in the community does not mean they cannot be an active board member. IMO, only if they live quite a distance from the community -- or out of state, would it pose a problem. You state it has not been done that way in the 10 years you have lived in the community, but that doesn't mean it can't be done that way. It's amazing how many assns operate in the mode: "Well, we've always done it that way!"
