I am a newbie to condo living. I have lived in the same apartment for 19 years and almost 2 years ago bought a condo. I have never been to a homeowners meeting because one has not been held. We have asked and asked but no responses. The property manager keeps telling us that he keeps asking. Can we call our own? What are the rules and regualtions or law for HOA's? Where can I find them? We want to vote the board director out how do we do that? Can anyone help>

The information you seek is in the documents you should have received when you closed. The Covenants and By-laws & rules of your Association you will need to read them, everything you asked should be spelled out in them.

Being that I am not from Texas, I do not have your HOA Laws or Statutes. Go to Google and find those laws. Now, normally, a certain percent of the membership (owners) can petition their Board, demanding a meeting be held. Do you have a Board? If there have been no meetings, it sounds like you have no Board. Does your property manager handle every function as for the operations of your association? That is a very scarey thing if there is no one who is checking up on that person as to bills being paid, contracts being taken care of and the biggesst item is where is the money being handled, by whom and is it all being accounted for?

That is a problem. The copy that we all have is very readable. It looks like an old typewrite copy. Someone is actually suppose to be checking theirs.

PatriciaR2: Are you certain that you are recorded as a Condo Community Association? Did you receive official documents, CC&Rs, upon your purchase two years ago? If you did not receive documents, then check with your local municipality. If it was recorded as an association, they will have a copy.

.?In the documents you will find Bylaws which will advise on the governing of your association---meetings, whether open to residents or closed, elections, assessment fees, restrictions, etc. Do you pay assessment fees to a Property Mgr.? Do you receive any communication pertaining to the Association at all?

There has been one special assessment fee since I've lived there. We do pay monthly fees. I could not answer about the Condo Community Association. I did receive bylaws but they are so hard to read. The only communication that we get or that I have received is thru the property manager. A couple of years ago the Board director (sounds of it from other residents) that he got sneaky and got everyone behind him and made all the promises. I can't even get an anser from the property manager about his term.

Patricia, you might check online with your county clerk or county recorders office. The CC&R's are legal documents and must be recorded and many counties have the documents available on their web sites.
