The streets in our development were under the control of our HOA while the developer was still building homes. When all construction was completed the developer turned over total control to the HOA. After all construction work had been completed, the streets were "dedicated" by the township, which meant they were now responsible for maintenance, snow removal, etc. A question was recently asked at one of our meetings regarding the authority of the HOA to impose restrictions on vehicles that park on the streets. Our Declaration prohibits utility trailers from being parked "on the premises", but the township doesn't have any restrictions on utility trailers. How do we enforce regulations in an area that we don't technically have control of?

Well, the township SHOULD have laws about vehicles blocking roadways,whether that is a car, buggy or truck. Lanes can't be blocked for firetrucks or other emergency vehicles.

Ask the township for signage on those streets that restrict or prohibit parking. What are other HOA's doing in similar situations?

we had a similar situation: our HOA controlled the common areas and even sidewalks, but NOT the street. If you parked something against our rules on your driveway, lot, etc., we could take action. However, if you parked it on the street, the most we could do was contact the city and have enforcement of the city codes started. luckily for us, no owners ever pushed that option.

Peny, I suggest you check the dedication plat to see if it states the HOA retains the rights to enforce restrictions which were in the CC&Rs at the time the streets were dedicated. If so, you should have the right to enforce.
