The chairman of the Architectural committee is the wife of the president.
There are two ARC volunteers accepted by the board, I have been denied be part of this committee.
I asked to have copy of the report of the last architectural Inspection but I have been denied this information by the president arguing that is private issue beetewn the management company and the Architectural committe!

How can I make clear that all board members have to be informed and must have access to all the manageemnt company documents.

BernardH - A committee that has volunteers accepted or approved by the board should not have more rights than a board member. Based upon your post it seems that is what is occurring. Are you a Board member?

based solely on what you wrote, it seems your president needs some education. Committee information is needed and open to ALL board members. the only exception i can think of is either:
1) the board member is under investigation by the committee for illegal activities
2) the board member has recused themselves from some decision for a conflict of interest

as a board member, nothing between the management company and the HOA should be private, and certainly nothing between committees and the board/management company should be off limits

BernardH: Based on this post and your other post, you have stated you are the 'new' Board member. Were you elected by the community members or were you appointed as a Board member to fill an unfinished term from one who had to resign.

As the new Board member, you must review your official documents to learn what the Board members are obliged to carry out pertaining to governing the community. This is the single most important thing for you to do--study the documents!

Re the ARC volunteers appointed by the Board, there is no need for ALL Board members to be part of the committee. Normally the ARC committee reviews ARC concerns/requests and reports back to the Board (as a whole, whether by email or in person at a Board meeting) and the Board then renders their decisions based on input from the ARC. Again, study the documents regarding Architectural Requests and how they are to be managed and processed.

You are the "newbie" here; you need to study, study, study, and observe. You will then have the documents as your ally when bringing your concerns to the rest of the Board. This is not a situation to be based on 'feelings' or personal beliefs; it is a situation of governing according to the legal documents of your community. To repeat, you want to ensure that you are included in all communications among Board members, and personally brought into all discussions with voting on decisions made. No one is a Lone Ranger, you are all the Board as a collective group!

Since reports from any Committee are included or attached to the minutes, and you are a Board member, you have access to all the offical minutes of the HOA.

The Inspection Report apparently is in the hands of the ARC Committee and that committee will report to the Board and outline the action it thinks should be taken, based on the report.
