When the Board of Directors decided to increase our dues they gave the homeowners 1 day notice that the increase was going to take effect. Is this legal?

KelliB - Wasn't the old fee due within the period they gave 1 day notice of the increase taking effect?

The new amount would be due the next day. We meet 1/31 @ 6:30pm. Dues are due on the 1st. Some people pay early so now the HOA management company wants the added difference mailed in. Shouldn't there have been a 30 day notice?

Kelli read your documents; what do they say about fee increases? Ours require a 15 day notice, others might not, the devil is in the details.

A lot of documents don't deal with the time period between when a board adopts an increase and when it is due. That would mean the assessment would be legal, even if it is stupid and insensitive. The board should provide some grace period for owners to "get caught up". If you're an owner, I would send the board a note making that suggestion.
