We have a property owner that has 5 lots. He does not want to pay 5 road fees. He says he's going to have the property lines legally abandoned..and then he would only have to pay 1 fee...What does this do to an association of 42 lots? Can everyone who owns abutting lots do the same thing?

He will have a real difficult time getting property lines declared "abandoned" - ask your local municipality about it.

Besides, when he tries to sell, he will be in a real mess.

You can file at the county courthouse to have the property re-platted to be one lot, but the HOA will still recognize it as 5 lots. If the owner sells, he will have to sell the whole thing.

First, i agree with Susan. Let him try to merge the properties, it will be a painful thing to do.

If he does, then you will have 37 lots. Take your budget, and divide by 37. Everyone pays a bit more for his actions every year. He pays more "per lot", but less overall than he did before. If everyone did it, you would continue to divide by smaller and smaller numbers, and increase the assessments to everyone.

On the plus side, he only gets one vote (one lot) in any elections, etc. Right now, he has 5, so he loses political power to save economically.

Lots of luck to this guy because the County reccognizes the original platt. Unless the owners want to have that redone, he still has 5 platted units of land. I have 2 lots with my house just on one lot. I oay 2 asets of dues, one for my house lot and one for my bare lot. That's the way it goes with a platted developement in my State.
