Ok, first... I'm currently a board member, yea me... ugh.

We currently for the last two years have had an on going issue at our pool. Two adult men, in their 30s/40s, are getting obsessively drunk, and our paying a lot of attention to teen girls, talking, touchy-feely... yes its rather creepy. And they wear very skimpy men's euro cut style swim wear.

Last year, after a young lady reported a incident, a few other young ladies came forward and reported the same creepy vibes from these guys. On two occasions last year, physical conduct was made. The two guys were horse playing with one teen girl and in the horse play, grabbed her breast enough where the girl immediately left... on the other occasion, one of the guys cohearsed a young lady to sit on his lap while he swam in the pool.

Other girls reported they felt very creeped out and uncomfortable with those guys talking to them, things they said, etc... all in all about 6 girls involved (last year).

4 of the girls, two whom are sisters, all reported the incident to law enforcement. In the end, it seemed to have died there. LE took the incident report but nothing seemed to have come of it.

The incident was reported to our management company and attorneys, both siding they didn't feel it was enough to ban them from the pool.

Fast forward to this year...

Its starting all over again. The drinking is out of control, the creepy friendliness toward teen girls, girls feeling weirded out, etc... the only thing so far this year is there has been no physical contact. But, after reviewing camera footage yesterday, it appears there may now even be more going on, but its all perception... it looks like they may be snorting stuff up their nose (I presume cocaine) but just my one-sided presumption, and they are incredibly fidgety and can't sit in one place for more than 30 seconds before having to get up...

Now, sadly, our HOA CCRs are generic at best, and our pool rules are very loose. Nothing in our pool rules mentions anything about alcohol, drugs, swim attire, or being drunk.

I'm not sure what to do to. Adults message me about the issues and are afraid to call LE themselves as they don't want to be involved in any drama with these guys. Another board member refuses to even want to address any pool rule or do anything about these guys... and he's LE himself. The other board member seems to be more talk then action when it comes to this matter. Our management company isn't advising us on any course of action, mostly because residents only complain to me, and then don't follow-up with the management company.

Many parents at our pool just keep their distance and turn a blind eye... not their kids, not their problem.

What options do I/we have?

If you have these guys on video assaulting the girls or doing anything else inappropriate, and you have a written complaint from the girls attacked, and your attorney refuses to write them at least a letter of warning, then find another attorney.

For one, the board's tolerating an environment obviously hostile to females is a Fair Housing violation. A real attorney would send a letter informing these men to cease and desist or they will be banned from the pool.

But you must have a complaint from the girls, along with the film footage.

Next revise your pool rules to ban recreational drugs and booze from the pool.

Thanks for your response. I didn't mention that after the incident last year is when we put in the camera system.

So technically, no video of them assaulting the girls. Just the complaints with the sheriff office.

- How old are the girls? It looks like the age of consent in Ohio is 16. I'll spare further comment except that that would perhaps explain the lack of police interest.

- Is it an HOA or a Condo, and how many units? How many people are on your Board?

- My first thought is that pool rules about drinking, drugs, etc, are typically in your HOA's Rules & Requirements, and thus if you need to, you could update them with a simple Board vote to ban alcohol, illegal drugs, glass containers, etc. Enforcing those rules is a separate topic.

- Do these guys actually live there? What kind of access control does the pool have? *Can* you lock them out?

- I'm sure I'll regret bringing this up, but is it the same group of girls who are having problems with these guys? There's something about this story that seems 'off' to me. You mention "drama" - and I believe it. I would not think it takes a lot of this kind of thing before these guys get a reputation as jerks and everyone avoids them.

- Even without these idiots, you should definitely have pool rules that prohibit alcohol, drugs, and glass containers. It's just common sense.

Bill, I appreciate your response. First and foremost, all girls involved are under the age of 16, then and now. Secondly, regardless if its the same girls, grown men should NOT EVER have inappropriate contact be it verbal or physical from grown men; adults know better. So I won't and will not blame or point fingers at the girls.Its an HOA, 175 homes. Yes, I agree the rules need tightened up, but one of the hold ups is 1 of 3 board members unwillingness to change the rules, and the 2nd of 3, not making decisions because he doesn't want to be between to board members fueding about this.Yes, agreed, what seems off about it is watching the videos and seeing the creepy approaches by the grown men and their tactics with these girls. They ride a fine razors edge between grooming and being friendly.

Yes they live in the NH/HOA, and we have key access only. Which I already know where you're going with that. Unlike many HOA communities in Texas and Florida, we are relatively small, and spending the money to add a fob or code system isn't budget friendly for us right now... its already hard enough to stop people from just opening the gate for people (thats another subject).
