When our community was built, the developer placed a chain link fence on a berm and planted border shrubs to hide the fence. The fencing runs the boundary of about 40 homes and is on the homeowners property. Initially, the fencing and shrub care was handled by the landscaper, but that ceased about three years into the community's existence. Now the fence needs repaired and the shrubs need to be replaced as they are dying and the HOA is telling the homeowners that it is their responsibility since it is on their property. Is there any recourse in this case or do the homeowners just have to bite the bullet and replace the fence and shrubs?

Our governing declaration has a landscape paragraph as to association responsibilities and owner responsibilities. Please review your documents and may be your governing documents will have your answer.

I agree with Michael's post.

In addition: How many homes does this single family home HOA have? Because if the total number of homes is close to 40, then whether the HOA pays (by assessing each home) or each owner pays is pretty much going to be a wash.

Unless there is something in the governing docs that say owners are responsible, I'd say there is nothing stopping an owner from just removing the fence and landscaping if it is on their property and in disprepair.

Except that doing that would be an exterior change and most CC&Rs require prior approval for exterior changes.
