Is the HOA (board) required to be more transparent with giving us a monthly report of notices or fines issued for non-compliance? In my previous community, on a monthly bases, these report were sent out. That allowed us to see that both the board and management company were doing their job. In this case, that information is not being shared. What can we do to make that happen?

Florida statutes do not require publishing a report of notices or fines issued for non compliance. In fact there are special conditions pertaining to disclosure of such notices and fines, designed to protect privacy and minimize liability.

You can check FS 720 to see if it allows owners to individually request such a report, as part of owners' rights to review certain HOA records.

My understanding is that the open records section of FS 720 does not require the association to provide any information on request. It allows for inspection and copying of records.

Normally HOA laws do not require financial information to be distributed on a monthly basis. Nor does Florida law require an HOA board to meet at specified periods.

In FS 720 there is a very specific process before a community can fine an owner. There are required notices and hearings at an open board meeting to assess the fine, then a meeting at an independent fining committee to uphold the fine. Then there is a 30-day waiting period before the actual fine can be levied.

Both the minutes of the board meetings and the fining committee are public records. You can submit a request to review the minutes, although at least the board minutes are usually posted to an association website. Even if they are not, they have to be made available with a records request.

Most of the time non-compliance issues are settled before the board meeting or at least before the fining committee, so there might not be much of a paper trail for non-compliance.

I don't see why it is important that all compliance issues be published somewhere. They may be taking care of the issues privately. If you don't think the board and management company are, you have have the right to speak at one of the board meetings. Or you could send a records request and ask for any correspondence regarding compliance issues for the last year. They don't have to copy it for you or send it to you via email, but they have to make the records available for you to copy and you may be charged for the copies.
