Florida State Representative Juan Carlos Porras of Miami-Dade County is actively considering and preparing to file a bill to abolish or significantly restrict homeowners' associations (HOAs)

This is part of war on HOAs in Florida.

I expect, if such a law is adopted, that it will apply to future developments and not existing developments/HOAs.

Realistically, I doubt such a law would be adopted.
This would be because of the added expense municipalities would incur to maintain additional roadways for new developments.

Dean, Tim...interesting topic. Voter apathy AT ALL LEVELS, all issues, seems to be the standard. Pitiful, but it is what it is!

Unfortunately the FL legislature doesn't seem too concerned about burdening cities and counties. There is a another proposal to eliminate property taxes, raise the state sales tax, and have the state government fund the local governments with the local governments having little to no ability to determine their own budgets.

Per this article from a tv station:

"Porras has not yet filed a bill or given a timeline. Lawmakers return to Tallahassee for the 2026 session on January 13."

The problem is that the legislators from Broward and Miami/Dade, who have the most issues with crooked HOAs, see this as an opportunity to make their political fortunes. They grandstand on social media and make all kinds of wild pronouncements. This one will never pass, even if it actually gets proposed. But some of the recent awful legislation that was passed was proposed by one of the legislators from that area. She's awful. The laws are very poorly written with no thought about who is going to enforce and how that is going to be paid for. It's a state where special interests rule the legislature.

I agree. I expect a number of cities and counties have municipal law that requires HOAs. I think city and county governments are very pro-HOA and will lobby against any such legislation.

Maybe, I can’t see any prejudice for or against HOAs in my local level. All they are concerned about is commercial development.
